Accessing the lincastudio.com e-commerce website for information, visiting, or shopping implies acceptance of the terms and conditions stipulated below. The owner of lincastudio.com reserves the right to modify these provisions without prior notice.

The content and design of the lincastudio.com website, as well as any other material related to it sent to you via email or provided to you by any other means (e.g., articles, design, product descriptions, and any other materials), belong to LINCA STUDIO SRL and are protected by intellectual property laws. You may not use, reproduce, or allow anyone to use or reproduce the materials from lincastudio.com without prior written permission from the Company.

You may not use frames (in the sense of HTML language) or framing techniques (in the sense of HTML language) for trademarks, logos, or other information protected by copyright law (including images, texts, interfaces, forms) from lincastudio.com without prior written permission from the Company.

You may not use the company logo or other graphic properties, or trademarks as part of hyperlinks without prior written permission from the Company.

According to the Electronic Commerce Law no. 365/07.06.2002, this online store represents an "information society service."

Therefore, this online store is merely a graphical interface presenting the information provided by a product supplier to the recipient and offering the technical means for making purchases.

Product Descriptions

lincastudio.com strives to be as accurate as possible. However, lincastudio.com does not guarantee that product descriptions or other related materials are accurate, complete, current, or error-free, thus exonerating itself from any responsibilities regarding:

  • the accuracy of the information attached to the products - descriptions, characteristics, technical data, photos, etc. These were taken as is from suppliers. The lincastudio.com store only has the obligation to present this information in an attractive graphical form for the client (photos, text, sizing, layout, etc.).
  • ambiguous statements, expression errors, mismatches between the purpose for which a product was purchased and its functionality.
  • differences between how product images appear in the store and the products received, concerning color, shade, accessories, and others.
  • defects, damages, or accidents caused by the appropriate or inappropriate use of products purchased from this online store.
  • the commercialization of products in compliance with legal conditions, which is solely the responsibility of the suppliers.
  • the stock availability of displayed products, as they are stored at suppliers and sold within the stock limit. Therefore, the store may not be able to fulfill a particular order if the requested product is no longer in stock or in the supplier's offer.
  • delivery delays due to the supplier, courier, or other reasons. Damages, destructions, or losses during transport to the recipient fall under the carrier's responsibility.
  • incorrect information provided by the buyer. They can correct their personal data at any time from the account created in the store.
  • the lincastudio.com store reserves the right to refuse to execute certain orders without justifying this choice, with email notification to the client.
  • the possibility of contracting viruses by accessing this store or receiving informative or promotional emails.
  • inconveniences created by internet service provider-caused access interruptions in the store.
  • the content or nature of sites whose links lead a client to the store.

Product Returns

The lincastudio.com client can return products purchased through a Contract in the following situations:

  • Parcels show severe damage;
  • Products were delivered/invoiced incorrectly;
  • Products have manufacturing defects;
  • Products have incorrect sizes ordered by the Client;

"The consumer has the right to notify the merchant in writing that they renounce the purchase, without penalties and without invoking a reason, within 14 working days from receiving the product." Also, according to OUG no. 34/2014, the Client has the right to unilaterally terminate the remote contract within 14 working days from the date of receipt of the product/products, without penalties and without invoking any reason. In this case, the direct return costs will be borne by the Client, according to the law.

The client is obliged to notify their intention to return the purchased products in writing (email) within a maximum of 14 working days from receiving the products.

The client who has notified LINCA STUDIO SRL according to art 7.8.2 is responsible for ensuring that the referred products will be returned within a maximum of 14 working days, otherwise, LINCA STUDIO SRL will consider the request unfounded/invalid and may refuse the return.

The client may not return the purchased products and/or claim any other damages/compensation in the following situations:

  • In case of replacing the purchased product with another product with different specifications or of a different type, except for the situation provided in art. 7.8.1.4.
  • If the return request for any of the situations provided in art. 7.8.1 has a notification dispatch date that exceeds the 14 working days provided under art 7.8.2, calculated from the working day following the honored contract date.
  • If a product is returned with one of the situations provided in art. 7.8.1 as a motive, and the returned product is not in the same condition as delivered (in the original packaging with all intact labels and accompanying documents).

According to OUG no. 34/2014, lincastudio.com reserves the right not to accept the return of products that, by their nature, cannot be returned or that can degrade or deteriorate rapidly, such as lingerie, swimwear, and/or cosmetic products. The client will be informed on each product page if the product is returnable or not. Products that constitute a set must be returned as a set.

In the case of refunding the product's value, this will be done within a maximum of 30 days from return confirmation.

If the product is replaced with another with the new size ordered, according to 7.8.1.3, the replacement will be made under the conditions and limits of a normal order.

If the client who returned a product in accordance with the provisions of art 7.8.1.3, and lincastudio.com does not have a suitable product for replacement, it will offer the client the product's value according to 7.8.5.

The value of additional services, including but not limited to product transportation, paid by the client, is non-refundable.

In all cases, return/re-shipping costs will be borne by the client, except for the situations presented in points 7.8.1.1; 7.8.1.2; 7.8.1.3, as well as in case of non-compliance according to 7.8.1., where lincastudio.com will cover the transport cost. Also, in case of delivery of unordered product(s), according to chap. 7.3., the return costs are the responsibility of lincastudio.com.

Delivery Time

For products in stock, the delivery time may range between 1-3 working days for courier shipments.

These terms are indicative, commonly practiced, and may vary due to factors such as calamities, exceptional weather conditions, road infrastructure conditions, strikes, etc.

The lincastudio.com store has no responsibility for adhering to these terms.

Applicable Law

The services offered by LINCA STUDIO SRL through lincastudio.com are governed by Romanian law, particularly Law 365/2002 on electronic commerce, Government Ordinance 130/2000 on consumer protection in the conclusion and execution of distance contracts, Government Decision 448/2005, and European Directive EC/96/2002, which regulates the green stamp fee applicable to electronic products.

The terms and conditions of lincastudio.com are subject to Romanian law. In case of dispute, an amicable resolution will be sought within 30 days from the complaint's registration. If no agreement is reached within the specified period, disputes will be submitted to the competent courts in Bucharest.

Force Majeure

The owner and administrator of lincastudio.com cannot be held responsible for any delay or error resulting directly or indirectly from causes beyond their control. This includes, but is not limited to, errors in the operation of lincastudio.com technical equipment, lack of internet connection, lack of phone connections, computer viruses, unauthorized access to lincastudio.com systems, operational errors, as well as cases of force majeure as stipulated by Romanian law.

  • We use your personal data for account administration on lincastudio.com, delivering ordered products, and managing and maintaining site records.
  • By purchasing products from our site, you agree to the collection and processing of your personal data.
  • All transactions initiated on this website are confidential. Your name will not be added to any third party's contact list.
  • We collect information about you to process your online order. The collected information will be used to keep you updated with all offers, discounts, or promotions that lincastudio.com has ongoing (only if you have agreed to receive these emails/newsletters when you registered on our site).
